Terms & Conditions

These terms govern your use of the TrueHost website and the services provided by TrueHost. TrueHost is a trading name of James Beachen, a sole trader based in New Zealand ("TrueHost", "I", "me"). By enquiring through this site or engaging me to build or maintain a website, you agree to these terms.
1. The service
TrueHost designs, builds and maintains direct booking websites for independent accommodation hosts, and can set up related tools such as online payments, calendar syncing, automated guest emails, a host dashboard, review collection and Google Business Profile optimisation. The exact scope of any project is agreed in writing before work begins.
2. Briefings and quotes
Submitting a briefing form or exchanging messages does not create a contract or any obligation on either side. Any pricing I share is an estimate until confirmed in writing. Work begins only once we've agreed on scope and pricing.
3. Fees and payment
- Standard pricing is a one-time setup fee plus a flat monthly fee, both quoted in New Zealand dollars (NZD). Current pricing is shown on the home page and may change for new clients from time to time.
- Promotional pricing (for example, a launch discount) applies only as described at the time and to the clients it specifies.
- One-off or custom work is quoted individually before it starts.
- The monthly fee covers hosting, security, ongoing operation and reasonable support and changes. It is billed in advance and can be cancelled at any time.
- TrueHost is not currently registered for GST, so no GST is added to these prices.
4. The build process
You'll provide the content I need — such as your property details, photos, rates and policies — and confirm everything before your site goes live. Timelines are estimates given in good faith. I'll always show you the work for review before publishing.
5. Third-party services
TrueHost relies on a few third-party services to deliver your site — namely Stripe for payments, together with website hosting and email-delivery providers. Your use of those services is subject to their own terms, and you're responsible for holding and maintaining your own accounts where required (for example, Stripe). TrueHost is not a booking platform and isn't responsible for outages, changes or decisions made by those providers.
6. Bookings and guest payments
Guest payments are processed through your own connected payment account (for example, Stripe) and go directly to you. TrueHost takes no commission on your bookings. TrueHost is not a party to the booking between you and your guests and is not responsible for guest payments, refunds, chargebacks, cancellations or disputes.
7. Your responsibilities
- Provide accurate, lawful content and keep your rates, availability and policies up to date.
- Operate your accommodation in line with all applicable laws, licences and tax obligations.
- Handle your own guest communications, bookings and obligations to guests.
8. Cancellation
You can cancel the monthly service at any time; it will stop at the end of your current billing period and your site will be taken offline unless we agree otherwise. Setup and custom-work fees cover work already performed and are non-refundable once that work has begun, except where required by law.
9. Intellectual property
You own your own content — your text, photos, brand and guest data. TrueHost retains ownership of the underlying systems, code and templates used to deliver the service; while you're subscribed, you have a licence to use the website built for you. Your custom domain remains yours.
10. Warranties and liability
I take reasonable care to build and run reliable, secure websites, but the service is provided on a reasonable-efforts basis. I can't guarantee a particular number of bookings, revenue, search ranking or uninterrupted uptime. To the fullest extent permitted by law, TrueHost's total liability arising from the service is limited to the fees you paid in the three months before the claim. Nothing in these terms limits rights that can't be excluded under New Zealand law, including the Consumer Guarantees Act 1993 where it applies.
11. Changes to these terms
These terms may be updated from time to time. The version published here with its "last updated" date is the current one. Material changes affecting an active engagement will be communicated to you directly.
12. Governing law
These terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction over any disputes.
